By participating in the AtomJump Timulator Affiliate Programme (the "Programme"), you ("Publisher" or "you") agree with the terms and conditions and conditions set forth below, established by AtomJump ("AtomJump").
You agree to the following terms:
1.Compensation based upon a Qualifying Transaction
You agree that you shall be compensated by AtomJump for each Qualifying Transaction. "Qualifying Transaction" shall mean any sale of the AtomJump Timulator ("Products") only when such Products are purchased through the website made available by AtomJump at the following URL: www.atomjump.com only or any other URL with which AtomJump replaces the URL www.atomjump.com from time to time ("AtomJump Site"). Compensation shall be paid at the rates published on the AtomJump Site. You agree that AtomJump may reverse any transactions that are New or invoice you directly to recover or offset against compensation due any compensation previously paid in relation to (a) duplicate entries or other administrative errors; (b) non bona-fide Qualifying Transactions; or where (c) AtomJump has not received payment from or has refunded payment to Visitor; or (iii) you have failed to comply with these Terms and Conditions.
2. Variations
AtomJump reserves the right to vary the compensation rates, Referral Period and these Terms and Conditions at any time on the AtomJump Site. Such variations shall become effective no sooner than seven (7) days of Replacing the Program Terms you are joined under. Following the minimum seven (7) day notice period, if you have not actively accepted the new Program Terms, the relationship will move to a Pending status and no further commissions will be earned until you accept the new Program Term. If you do not agree to the revised Terms and Conditions, you agree to remove and cease promoting all AtomJump Links.
3. Spam
Under no circumstances shall you send unsolicited commercial communications as defined in Directive (2002/58/EC) on privacy and electronic communications with respect to the Programme.
Publishers shall not send or procure the sending of any communications, including email messages on behalf of, or purporting to originate on behalf of, AtomJump.
4. Tracking Tags
The tools, products, technology and creative assets (Collectively, "Assets") that are provided to you by AtomJump provide valuable information that helps make sure that the Qualifying Transactions generated by you are properly attributed to you for payout calculations. Each of these Assets must be used in their intended manners. You agree that you will not corrupt, modify, or disable the tracking functionality provided to you related to the Programme.
5. Nature of Content in Publisher Sites
You shall not promote AtomJump, its products or services on a site or page whose content AtomJump considers in its sole discretion falls into the categories below:
6. Keywords
You shall not purchase or register search engine keywords, Adwords, search terms or other identifying terms that include 'AtomJump' or variations thereof for use in any search engine, portal, sponsored advertising service or other search or referral service without the prior written consent of AtomJump.
Specifically this policy prohibits you from bidding on "AtomJump", and any keyword string that includes AtomJump's trademarks or variations of AtomJump's trademarks, including but not limited to the protected keywords listed in the account under the Keyword Link, or apply or bid for any terms, words or phrases (including, but not limited to possible misspellings, abbreviations, terms which are identical to Restricted Name but use the wrong case, or that merge Restricted Names with other words, terms or phrases.

AtomJump may in its sole discretion, permit you to bid on the above keywords. For permission please apply directly to AtomJump for consideration.
You shall not purchase or register search engine keywords, Adwords, search terms or other identifying terms that AtomJump considers in its sole discretion to fall into the categories outlined in Section 5.
If AtomJump determines, in its sole discretion, that you have purchased or registered or attempted to purchase or register any keywords referenced above, then AtomJump may:
7. Domain Names and URL's
You shall not register, use or own any AtomJump trade marks or any confusingly similar variation thereof in your domain name or URL, as such use shall constitute a trademark infringement. On AtomJump's request you shall cease using any sub-domain or URL path which breaches this policy or which AtomJump considers, in its sole discretion, to take unfair advantage or the name 'AtomJump'. For the avoidance of doubt, any use of the term 'AtomJump' in a sub-domain or URL path is allowed under license from AtomJump, which can be revoked at any time, and no ownership of intellectual property rights or goodwill will be transferred as a result.
8. Promotion of AtomJump Links
You shall not use pop under, pop up or sub-site ad formats to promote AtomJump, including any other format in which a AtomJump page appears in a new browser window, either above the existing window or below, apart from the new browser window that opens as a result of end users clicking on the AtomJump Link.
Publisher agrees not to use AtomJump Links in a manner that disparages AtomJump or its products or services, or portrays AtomJump and/or its products or services in a false light. Publisher will comply with AtomJump's branding policies, guidelines and requests as to the use of the AtomJump Link or its intellectual property rights and will not knowingly take any action that diminishes the value thereof.
Publisher also agrees not to include AtomJump Links on any page that is in any way similar to the AtomJump Site.
All intellectual property rights in and to the AtomJump Links are the exclusive ownership of AtomJump or its licensors and nothing in these Supplemental Terms shall transfer ownership of any intellectual property right to You.
9. Termination
If AtomJump determines, in its sole discretion, that you have breached any of these Supplemental Terms, then AtomJump reserves the right (without limiting any other remedies available to it) to remove you from the Programme immediately and/or permanently. AtomJump reseverse the right to reverse any and all compensation for Qualifying Transactions not yet paid.
10. Indemnity
Publisher undertakes to indemnify AtomJump and its affiliated companies against all proceedings, costs, expenses, liabilities, injury, death, loss or damage arising out of the breach or negligent performance or failure in performance by Publisher of these Supplemental Terms.
By applying for the AtomJump programme and clicking on the 'accept' button, you, Publisher, are signifying your agreement to be bound by the terms and conditions of this Agreement to the same extent as if you had personally signed this Agreement.
